Constitutional Court of Bosnia and Herzegovina
The highest judicial authority in Bosnia and Herzegovina, responsible for upholding the Constitution and resolving disputes between entities and state institutions.
Composition
- •9 judges total
- •4 judges selected by the House of Representatives of the Federation of BiH
- •2 judges selected by the National Assembly of Republika Srpska
- •3 non-citizen international judges appointed by the President of the European Court of Human Rights
Powers
- •Exclusive jurisdiction to decide any dispute that arises under the Constitution between the entities, or between the state and the entities.
- •Reviewing whether entity constitutions or laws conform to the state constitution.
- •Appellate jurisdiction over issues under the Constitution arising from a judgment of any other court in Bosnia and Herzegovina.
- •Determining whether a proposed law violates a Vital National Interest of a constituent people.
How members are chosen
Selected by legislative bodies as described in composition. Judges serve until they reach age 70, unless they resign or are dismissed by consensus of the other judges.
Veto and blocking mechanics
Decisions are made by a simple majority vote of the 9 judges.
